2. Scope & Effective Date

These Terms & Conditions ("Terms") govern your access to and use of the ContactPro multi-channel communication platform ("Service"), including all related APIs, tools, and interfaces provided by Bithuszárok Bt. ("we", "us", "our").

These Terms become effective upon account registration or, if earlier, upon your first use of any part of the Service. By using the Service you confirm that you have read, understood, and agree to be bound by these Terms.

3. Service Description

ContactPro is a Software-as-a-Service (SaaS) multi-channel communication platform that provides:

  • Contact and subscriber list management
  • Campaign creation, scheduling, and delivery across email, SMS, and additional channels as they become available
  • Automation workflow design and execution
  • Analytics, reporting, and delivery tracking
  • A built-in AI assistant and agent-compatible API
  • Integration connectors for third-party messaging channels (Facebook Messenger, Viber, WhatsApp, and others)

We may add, modify, or remove features at any time. Where a removal materially reduces the Service, we will provide at least 30 days' notice.

4. Account Registration

To use the Service you must register an account. You agree to:

  • Provide accurate, complete, and up-to-date information during registration
  • Register only one account per legal entity
  • Keep your login credentials confidential and not share them with third parties
  • Notify us immediately at info@bithuszarok.hu if you suspect unauthorised access
  • Be at least 18 years of age (or the age of digital consent in your jurisdiction, if higher)

You are responsible for all activity that occurs under your account.

5. Subscription Plans & Pricing

ContactPro offers a free tier with limited features and quotas. Paid subscription plans are available with expanded capabilities; current pricing is published at contact-pro.eu/pricing.

We reserve the right to change pricing with at least 30 days' written notice sent to your registered email address. Continued use of the Service after the effective date of a price change constitutes acceptance of the new pricing.

6. Payment

Paid subscriptions are billed in advance, on a monthly or annual cycle as selected. Accepted payment methods include bank transfer and credit/debit card.

  • Subscriptions auto-renew at the end of each billing period unless cancelled before renewal
  • Fees are non-refundable for periods already commenced and used
  • In the event of non-payment, we may suspend your account after a 7-day grace period and terminate it after a further 30 days

7. Acceptable Use

You may use the Service only for lawful purposes. You must not use ContactPro to:

  • Send unsolicited bulk messages (spam) — see our Anti-Spam Policy
  • Send messages to purchased, rented, or harvested contact lists
  • Distribute malware, phishing content, or illegal material
  • Impersonate any person or entity
  • Violate the rights of any third party, including intellectual property rights
  • Circumvent any technical restrictions or rate limits of the platform

You must comply with all applicable laws and regulations, including GDPR, CAN-SPAM, CASL, and the terms of any third-party channel you use through ContactPro (including Meta's Messaging Policies for Messenger). Detailed messaging obligations are set out in the Anti-Spam Policy.

8. Intellectual Property

The ContactPro platform, software, user interface, and all associated intellectual property are owned by Bithuszárok Bt. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purposes during the term of your subscription.

You retain full ownership of all content you upload, create, or transmit through the Service ("Your Content"). By using the Service you grant us a limited licence to process and store Your Content solely as required to provide the Service to you.

9. Limitation of Liability

The Service is provided "as is" and "as available". We make no warranties, express or implied, regarding availability, accuracy, or fitness for a particular purpose.

  • We do not guarantee specific delivery rates, open rates, or click rates
  • We are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service
  • Our total aggregate liability to you for any claim arising under these Terms shall not exceed the fees paid by you in the three months preceding the claim

Nothing in these Terms limits liability that cannot be excluded by applicable law (e.g. liability for fraud or personal injury caused by negligence).

10. Term & Termination

These Terms apply for the duration of your use of the Service.

  • By you: You may terminate your account at any time via the account settings or by contacting support
  • By us: We may terminate or suspend your account with 30 days' notice, or immediately for material breach of these Terms (including the Anti-Spam Policy)
  • Data after termination: Your data will be retained for 90 days after termination to allow export, after which it will be permanently deleted

11. Governing Law & Jurisdiction

These Terms are governed by the laws of Hungary. Any disputes arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the Budai Központi Kerületi Bíróság (Budapest Central District Court), Hungary.

If you are a consumer in the EU, you also have the right to use the EU online dispute resolution platform at ec.europa.eu/consumers/odr.

12. Changes to These Terms

We may update these Terms from time to time. We will provide at least 10 days' notice of material changes via email to your registered address. The updated Terms will be published at contact-pro.eu/eula.html.

Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms.

Data Processing Addendum (DPA)

This Addendum forms part of the Terms & Conditions and governs the processing of personal data carried out by ContactPro (Bithuszárok Bt., "Processor") on behalf of the User ("Controller") in connection with the Service, in accordance with Article 28 of the GDPR.

1. Role of the Parties

When you use ContactPro to manage your contacts and send messages to them, you are the Data Controller and we are the Data Processor. We process personal data of your contacts only on your documented instructions.

2. Lawful Instructions

We will only process personal data on your behalf in accordance with your lawful written instructions, including as set out in these Terms. You warrant that you have the appropriate legal basis to instruct us to process personal data on your behalf.

3. Confidentiality

All personnel authorised to process personal data are subject to binding confidentiality obligations.

4. Security Measures

We implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk, including encryption in transit (TLS 1.2/1.3), encryption at rest, access controls, and regular security reviews.

5. Sub-Processors

We use the following sub-processors: Contabo GmbH (infrastructure hosting, Germany). We will notify you of any intended changes to sub-processors at least 14 days in advance, giving you the opportunity to object.

6. Data Subject Rights

We will assist you in fulfilling your obligations to respond to requests from data subjects exercising their rights under Chapter III of the GDPR (access, rectification, erasure, restriction, portability), taking into account the nature of the processing.

7. Security Incident Notification

We will notify you without undue delay (and in any event within 72 hours of becoming aware) of a personal data breach affecting your contact data.

8. Deletion & Return of Data

Upon termination of the Service, we will delete all personal data processed on your behalf within 90 days, unless retention is required by applicable law. We will provide confirmation of deletion upon request.

9. Audit Rights

We will make available all information necessary to demonstrate compliance with this Addendum and allow for and contribute to audits conducted by you or a mandated auditor, subject to reasonable notice and confidentiality obligations.

10. Applicable Law

This Addendum is governed by Regulation (EU) 2016/679 (GDPR) and Hungarian civil law.
